Bought a new iPod on eBay. Received today to find it was used. What can I do?

I purchased an iPod nano on eBay for my friend's birthday. The item title and description said the iPod was new. Just looking at it through the case I can see dent from where it was dropped as well some scratches. Looking closer, the box has been sealed with tape from home, a very lousy job I might add. Can I return this back to the seller? If he won't accept it can I report him to eBay or am I left with only being able to leave him negative feedback? Thanks

the only thing you can do is email him and tell him how much of a lowlife he is for lying to people, and leave him negative feedback AND NEXT TIME,  you need to be more carefull when you read descriptions on ebay and look at the pictures closely, you also have to read the wording in each of the descriptions EX// PS3

NOw; if u purchase the above item, u will be recieving a box, not a PS3, only a BOX, an EMPTY box

You can report it to ebay - that the seller has sold an item not identical to its description.

I would first mesasge the seller and tell him that you are not pleased with the condition of the iPod, and would like to return it to him. If he does not reply, or says no.. I would report him to ebay.
