Bought item on ebay and never got it?

i payed for an item (pc) at the start of may on ebay. The person i got it off had a few complaining comments about long delivery time, but it didnt bother me.i payed iunstantly using a credit card and it hasnt came since then (3 months) i have sent numerous emails asking each one saying that its on its way. A recent email i sent said that the guy was in hospital so hel reply when he gets out so i replyed saying just give me a refund or il call the police. That was 2 days ago and i havent got a reply. Its been so long that the listing has been removed so i cant file a dispute on ebay! What should i do??Its been 3 months I ve got his email address and his name?

go on to paypal if that is what you paid for it with. One on paypal file a claim for the transaction. they will review the case and make an outcome.
