Bought some property and have a tenant that has been asked to pay rent or move.?

What do I have to do evict them from the property?

The property is in the state of Kansas.

I bought this property on the 1st of August, 2008.

I would like to take possession as soon as possible.

  1. hi you should have requested the property to be empty before you brought it . what tenant agreement as he/she got when does it expire ? you have to give 2 months written notice if they are still in there agreement or 1 month if the agreement has expired if they dont move out you will have to take them to court which i had to do but it took 4 months to get them out . The aug rented should have been given to you get them to show you the agreement .

  3. you have to look up the laws in Kansas.. here in Indiana you have to go to court and then they get 30days to get out after the court orders it... good luck!

  4. give them 30 days written notice to vacate , that is IF they don't have a lease . If they have a lease , you are stuck with them . If they have no lease , give the written notice I noted , then after 30 days , call the sherriff .

  5. Did the tenant have a lease?

    Did the tenant pay August rent to the Old Landlord if they did it was transfered to you at the close of escrow.

    If the tenant hasn't paid rent for August serve them with a 3 day pay or quit notice once the 3 days is up if their not out of the house start the legal eviction process.

  6. You should go to your local courthouse and check out the landlord tenant part of court, you should try and get him off the land as soon as possible.

  7. Each state has different laws when it comes to that. Here in Pennsylvania I had to go to a district court and get an eviction notice for someone that wasn't paying her rent. After many repeated calls and letters to her.  

  8. Did the tenant have a written lease with the previous owner?

    If they did..then guess what?  They DON'T HAVE TO MOVE.

    You are required to honor the lease until the end.

    Did you buy this property without your own Realtor?  If you had one, they would have told you that you needed to get a copy before placing an offer.
