my boyfriend is in jail and he got a letter in the mail on another charge to appear in another city's court otherwise they will issue a failure to appear and put a warrant out for his arrest..I called the courthouse and told them he is in jail, he can not make the appearance and they said they will put it in the computer and the judge will see it that day..do you think the judge will issue a warrant for his arrest?

  1. Yes, the judge will issue a bench warrant for him.  This is a matter of protocol.  All it does is announce to the jail that there is another charge.  Also let your BF know about the letter so he can tell his attorney.  The jail will writ him out to the other jurisdiction to face the charges there.  If it is not cleared up, and it may very well not be, when he is released from jail for the current charge, he could be facing a lot of other problems, i.e. failure to appear, contempt, etc.

Just let him know.  If nothing else, the shift Sargent can check the computer for other jurisdictions, and let him know what is up.

  2. Yes,

the court system is all about making money. If they can make some more money off of him, they'll do it. Don't believe them why they say the info will be entered into the computer.

  3. I don't know what state you live in but the probability is low since you called and told them.  So maybe the judge will be lenient and not add a warrant but what ever he has done it may add to the problem !but some counties have their own law so good luck !

  4. I doubt there will be an arrest warrant but there could be a "hold" placed on him after his release from where he is now. The other option is for the other Court to issue an order to appear and he will be transported to appear in the other Court while he is waiting for his Violation hearing.

Look, I'll be blunt. I know he's your boyfriend, but do you really want to spend your life with a guy that can't stay out of Court/Jail system?

  5. I'm pretty sure they wont arrest him He is already in jail. The judge may reschedule the Appearance or he will ask to release him for the time of the appearance
