Boyfriend not from u.s. ...if we marry how long does it take for him to be able to live and work in u.s.?

My boyfriend is from India, he currently lives and works in U.S.- F-1 expires in a month, if we marry how long does the paperwork take for him to be able to stay here and work as well?

    He needs to maintain legal status until at least he gets the Receipt Notice of I-485, which his status will become Pending Adjustment of Status.

    If you are Permanent Resident

    File I-130 after the marriage, then he has to wait until his immigrant visa is available according to Department of State Visa Bulletin which is about 5-6 years of wait. In that case, he has to either go back to country and wait or maintain other visa status such as another F1 or H1B. If you become US Citizen while he is waiting for the visa, you can change the status of sponsor to expedite his application.

  2. On an F1, I believe he has to go back to his own country.  You would then file for a fiancee visa to have him come back.

  3. If you are a US citizen, and you get married to him, he can stay in the US and adjust his status.  He does NOT have to leave.

    After you get married.....

    You file I-130, I-864 and G-325A.

    He files I-485, I-131, I-765 and G-325A.

    You file all these forms at the same time, in the same envelope.  The cost to file is $1,365.  You do NOT need an attorney.

    In about 90 days, or less, he'll get a work permit.

    In about 6 months he'll have his interview.

    In about a year he'll get his green card in the mail.

  5. o boy, it's going to take awhile to get legal status. The fiancee visa takes about 3years and it's still at the mercy of the US Embassy in India to approve to disprove the application.

    Successful applicants usually write to each other and maybe visit each other(means you have to go to India) with photographic evidence, and you need to earn a decent living.
