Breaking A Lease?

I know that if you break a lease you have to pay the remaining balance owed.. I also know that if the landlord broke the lease that I would still be obligated to pay the remaining balance owed..My situation is this... My landlord has a lot of people up and down and in and out of her apartment at all times of the night ( I live in the apartment below her) and it is bringing drug traffic and use into the complex.. is this cause to break my lease without paying because it has become an unsafe place for my kids to live.. We can not even sit outside without smelling pot. One of my daughters is an asthmatic...

  1. You need let the landlord know that you are aware and bothered by the activities taking place. Do so via certified mail return receipt requested. Only mention things that you are sure of - like the smell of pot. Do not mention drug dealing, unless you know this for a fact and have proof to back it up.She may just allow you to leave to get you out of her hair.

    Otherwise, you need to call the police so that you have actual reports to back up what you say. If you do nto do so, it is just a complaint after the fact and a judge will dismiss it.

    If you just bail out and then the landlord sues you, in order to bring up these activities, you need something to back up your claims in front of a judge.

  3. Personally I would break the lease and not pay the difference.

    Let them take you to court and then you can bring up all the drug stuff in the proceedings.

    Take care of your family first....move out.

  4. Sorry to say, you do not have cause to break the lease unless you involve the police in the drug use.  If you smell marijuana being smoked, call the police to report it.

    If you don't want to go to those lengths, be prepared to stay until your lease expires.
