Question:

British Citizenship: How to?

My partner is pregnant with my child, she is a Hong Kong citizen born in 1989, she lived in the UK for 10 years as a student. We have been dating for 2 years and she is due in march. Because of the no flying while pregnant 3 months before due date she has to fly over between Sept-Nov, so I feel rushed.

I do not mind marrying my partner but we would not have the money for a big wedding and I would rather wait a a few years to get a ring and give her a big wedding like most women want.

I don't even know if she will get citizenship if we marry..

Thanks

  1. So she doesn't have student status any longer? And she needs visa to get to the UK.

How do I qualify to join my fiancé, fiancée or proposed civil partner in the UK?

    You must show that:

you plan to marry or register a civil partnership within a reasonable time (usually six months)

you plan to live together permanently after you are married or have registered a civil partnership

you have met each other before

there is somewhere for you and your dependants to live until you get married or register a civil partnership, and you will be able to live without help from public funds, and

you and your dependants can be supported without working or claiming any help from public funds.

You will be allowed to stay in the UK for six months but without permission to work. When you are married or have registered a civil partnership, you can apply for a two-year extension to your visa and, if your application is granted, you will be allowed to work. Near the end of this time, you can apply to stay in the UK permanently. Before we can give you permission to stay in the UK permanently, you will need to pass the 'Life in the UK' test.

So you should get married or register a civil partnership within 6 months after your partner arrival. Otherwise she can't legally stay in the UK. You can just go and register without a big wedding, that can follow later anytime.

    About her getting British citizenship

If she is over 18 and has been living in the United Kingdom for the last five years (or three years if she is married to or a civil partner of a British citizen) she may be able to apply for naturalisation as a British citizen. She may also be able to apply for naturalisation if she or you as her husband or civil partner is in crown or designated service outside the United Kingdom. Applications for naturalisation are made using application form AN.
