What would the lawful way of saying Domestic Violence for a adult violating a child? Would that still be DV?

  2. I cannot speak for you because I do not know the true magnitude of the situation. However, I do advise you to wait a day or two and then see if you still want to send him to jail. Sometimes, when we are angry we make decisions without truly understanding their consequences, and then we regret them later.

  3. I take it you are a minor child and your brother is an 18 year old adult.  YOU yelled at him for dropping a cheez-it on the floor?! Count yourself as lucky he didn't turn you over his knee and spank you for being disrespectful of your elders.

  4. Try looking under your assault and battery chapters of the states penal code I think that you would find what your looking for in there. It would also be domestic violence, I don't know how New York is but here DV means someone is going to jail that night to be arraigned the next morning in front of a judge.

    Here its DV because you are related and living in the same household. the DV isn't an actual crime its just an enhancement to a battery/assault charge.

  5. call the police. if he doesn't get himself under control, someone is going to get hurt and it could be a cop hurting him.
