Question:

Building Shed and property line.?

Got home from work today and my neighbor started erecting a shed. They live on the corner lot so their back yard runs into my front yard. They started to build it right near the property line. So kinda an eye sore with a shed right outside front window. Would anyone happen to know the city/state ordinance laws concerning this. Links would be appreciated. Kent Ohio..Portage County

  1. Call the city and have them send out an inspector. The neighbor should have a building permit, and the inspector could actually make them correct it, before he gets it fully built.

    Or, you could ask your neighbor to not put it there, and see if he will move it. He might if you ask. If you offer to help, he might oblige better.


  2. This is a pretty common question in my world.  Here is what you have to do:

    1)  Contact your City or County offices (whichever is applicable) and talk to the Zoning and/or planning staff.  Ask them what the setback is for small structures (some structures like pre-fab  100 square foot storage sheds are exempt so be prepared with some rough sizes).

    2)  If there is a setback requirement it will usually be 3 to 5 feet.  Do you think the neighbor clears that?  If not then you can file a complaint with the building inspection department and the agency will take it from there.

    3)   BUT.. if you are on good terms with your neighbor this is not going to make his day, so why not go talk to him first.  You can always call the agency later, but that is a bell that is hard to un-ring.

    If you are not on any terms with the neighbor then dime him.

    4)  Lastly.. are you SURE about where your boundary line is?

  3. I think a building permit is needed only if foundation was put down.  Do you know the dimensions of the shed?  Depending on how big it is, it may or may not have to be three feet away from the property line.

  4. most laws usually are 3 feet away from the house, fence and property lines.
