Built on aunts land w/e permission? ?

My aunt and uncle own land in New Hampshire, they live near me in MA. They went up to visit because they kept a trailer on it for vacation, but when they got up they there was a house laying on their property and their trailer was possessed. This all happened with out them know about it, no one told them anything. They still own the land and wanted to make sure that the house was on their land so they hired land scrapers. They paid like 2.5k to them to survey it, and the people said their 90% sure that its my aunts land, but they want to redo it because the people living in the house had dogs wondering around, so they want them to pay another 2.5k...they went to the town to before they hired them btw and they said they have to...So whats going to happen? After all this is finished and their sure that this is their land, what do they do?If it is my aunts land do they keep the house, or do they need to pay for it, or do they get paid by the company who screwed up? Also the land was paid for and they were paying the taxes for it.

  1. They need to hire a local real estate attorney. Don't assume just because they have been paying the taxes on the land that they have all the rights associated with legal ownership. In some States if someone has been using the land for a period of time they have rights to it for that reason alone.

    If they did not have the land surveyed and fenced when they bought it they may have lost the right to the portion that the squatters are using. I read about a similar situation in Colorado and the owners lost the Court case!

    I would ask for my money back btw because if they are 90% sure-- they SURE as h**l didnt do their job. Then I would sue the people who built the house on their land and demand that they purchase at fair market value, or move the house all together.

    Their lack of planning does not make it your aunt and uncles fault.  There are squatter laws tho, so I would check them in your state.

  3. I guess it depends on if they mind a big house being on their land.  If they do, i'd demand the house moved.  If they don't mind the house being there, charge lot rent.
