Burglary question. Who would be responsible?

I own a housing assosiation property. I am responsible for all the repairs inside my house, and the housing assosiation is responsible for the communal area. For the last three weeks the lock on our communal front door has been broken and they haven't sent anyone to fix it. So if we get burgald our insurance won't be covered because our house isn't properly succured. Would the housing assosiation be responsable if we got burgald? Thanks

  1. Actually, theft is covered no matter who is at fault. What the insurance company would do is pay your claim then subrogate against your housing authority for being negligent by not fixing the locks. By subrogating the insurance company will recover the amount that they paid on your claim and possibly even your deductible or a percentage of your deductible.


  2. No, your responsibility begins at your front door.  

  3. As long as your front door, that is the one from your home to the communal area, is locked you will be ok with the insurance company.

  4. Insurance Adjustor is right.   I don't know why your company will not pay.   Do you have your own condo or townhome insurance?   The homeowners association insurance will not pay for your property.   You have to get your own insurance for that.
