Burning the american flag legality?

am i right in thinking its illegal in america to burn the american flag?

if so, then would it be illegal to burn it if it was just printed on some paper?

is the material it is made from the thing that determines whether it is illegal?

just bored / curious.

  1. Actually no, that is incorrect.

    In most of America it is perfectly legal to burn American flags. There are a few American nations that put restrictions on flag disposal i/e Cuba and the United States, but in most of America you do as you want.


  2. Do a little googling on the subject. You'll see it's quite an emotional issue for a lot of people.

    There are those who would like it to be illegal, they see it as disrespect to the flag and the country. When someone is burning a flag in protest, they are doing so to express their dissatisfaction with said country.

    There are areas where burning a flag would directly come into conflict with certain laws (ie, "open flame", etc.) even though burning of the flag may not be explicitly outlawed.

  3. It is not okay to just go out and start burning American flags. There is a certain way of doing so. It is only to be burned if it is worn and tattered. There is a ceremony in which this is done. Your local boy scouts probably hold one of these ceremonies at least once a year. It is  a great way to give back to the community as well. JROTC cadets also conduct the ceremonies so if you have one in your home town give them a jingle and they would be proud to help you and their country out.

  4. The US Supreme Court has explicitly ruled that the government cannot prohibit or restrict the burning of the flag.  

  5. If it is just a printed paper, throw it away. Sounds like you are trying to do something and want an okay here. Watch what you do because there are people who may violate your rights for doing so by whipping your butt. Your "statement" may be made from a hospital bed.

  6. You CAN burn the flag if you wanted to as a form of "freedom of speech" but if you did that in front of me I would express my own "right to express myself". The flag should only be burned if it gets torn and tattered as a way of respectfully disposing it.

    Although the actual act of burning a flag may be protected, how it is done so, may constitute a crime.  

    Lighting a flag on fire inside a school, congressional building or other structure would not be legal.  It's not the act of burning the flag, but the risk that burning the flag would create to the safety of others in the building.
