Bus car accident, Who's fault??

Ok so I just left my house for work at approx 730 am. At the end of my street immediately to the left is a bus stop and shelter, As I pulled out of my side street onto the main road I was blinded almost totally by sun glare and fog, as I got my barrings, I hit something before I even saw it, After I realised I'd been in an accident I looked around to see a bus parked on the left of the road partly in my lane, I had clipped the back right hand corner of the bus doing irrepairable damage to my car and some damage to the bus.

I never asked the bus driver why she was not parked at the bus stop maybe 150 metres before where she was parked, but I wonder whether that was illegal and whether I am definately at fault or is she more at fault. It was an 80km road quite busy at that time. I felt I did not actually do anything wrong, I was not speeding or anything like that I simply just did not see it at all, not even at the last minute. What a shock!! Any opiniions would be great, I now face a hefty bill and no car of my own, I definately will have learnt my lesson to have full insurance thats for sure. Thanks guys.

It doesn't matter why or if the bus was parked.  Unless ...The bus  jumped out and hit your car ?  Be glad you have insurance and don't worry about fault.  Since you have insurance, fault  makes little difference anyway.  Please do not start a question with "ok so"....spell check

  3. Sorry, you failed to use additional caution given the weather conditions.  You struck a stationary object.  You are at fault, but depending on the comparative negligence laws where you live, the other party may have some minor negligence if in fact they were illegally parked.

    If you cannot see then you must STOP.

    The bus is a very large object that is there to be seen.  "But he should not have been there for me to hit" is not a valid defense.

    You did not see it and hit it. If the sun and fog blinded you - then you should have immediately stopped. You do not continue to drive an automobile when you can not see.

  6. Unfortunately, whether she was parked legally or illegally...she was parked.  You struck a stationary object.  If you have a good adjuster, they may be able to throw a small bit of fault her way, but the bulk is on you.

  7. Explain this situation to your insurance company or to someone you know. I'm fairly sure the bus driver should have parked at the bus stop, but I'm not sure if how she parked was illegal.

    Consult someone with legal knowledge and what is legal/illegal on the road.

  8. unfortunately you're at fault because it was parked. Now unless the bus was not supposed to park there by code, and only at bus stops, you could throw a little on them. Did the bus obstruct your view in any way, they do designate bus stops for a reason you know.  my sister hit a parked truck parked on the wrong side of the road, she didnt see him as she was turning around the corner. the truck had no damage but my sister's car was BAD. anyway they deemed him at fault and they paid. GOOD LUCK

  9. You will be found at fault. You are pulling out from a minor road on to a major road, so it is your responsibility to make sure that it is clear, both in front of you and behind you before you pull out. I appreciate that you say that you couldn't see but any insurer who deals with the claim will tell you that if you can't see the road ahead, you should not be driving until you can see the road ahead. Where the bus stopped isn't really relevant as if you had been on the main road, and were driving behind the bus, you would have been obliged to leave enough room to stop safely between yourself and the bus, and the same applies when you pull on to a main road.
