Business Question: How can we stop the factory that is making our products, selling them on to anyone else?

We are only a small firm who have comissioned a 3rd party manufacturer to make our products for us according to our designs How can we protect our intellectual property in a business relationship like this and also worldwide.

Note: they are artistic ornamental products.

Any advice would be gratefully appreciated!

  3. You will have copyright to your designs. Make sure you keep all documentation and that it's dated as to the designs and paper work between you and the manufacturer.

    You need to contact the manufacture in writing stating they are to stop using your designs. Contact you local trading standards to get the exact wording. You need to be exact on this, as if it goes to Court, it needs to be in the correct legal jargon.

    You can ask for loss of profit, if you pursue this with a lawyer. Can you find out where they are selling these products to? Any documentation about how many they are selling and how much they are being sold for by your competitors will be useful. Document everything, print off websites etc if you find your products there.

  4. 1) talk with the principal of such factory to stop it cold, or else you are seeking for remedies to recover your loss + damage

    2) repeat such demand in writing, delivered by registered mail with return receipt or by server with affidavit

    3) file a lawsuit using an expensive venue but lawful in scare the factory owner

    4) search for new supplier while doing all of this or preferably before doing it

    5) report to the supplier's authority as well as yours seeking for remedies

    etc.

    (costly in most cases, time consuming but it is a must do)
