  1. There is no law that states that both drivers of an automobile accident have to have a breathalyzer.  

    But there are rules and regulations in fatal accident investigations that require drivers who are involved in such, submit to a blood test.  If the accident resulted in someone dying, it is a fatal accident.


  2. in california they do not have to. if they suspect alcohol they may do a test on the spot, or they may arrest the person and do a test at the jail. (if they do the test at the jail, especially blood, the BAC will be higher)

  4. in TX no they do not...only if the suspicion of intoxication by alcohol is apparent...however any po with experience will be able to tell if someone is drunk or intoxicated by something else...
