If the vehicle has been written-off and has a rebuilt title, then yes ( although laws may differ in different states and provinces ).  If the vehicle was just involved in a little fender-bender type of collision, then no.

This would be impossible to enforce. It's up to the buyer to do his research. That is why services like Carfax exist.
