By what law or statute does SC take $200 from a claim when the recepient was hit by an uninsured motorist?

Per my insurance's claim representative, the deductible is a SC state mandate not something on the insurance company's end.

  1. Read your policy. The company will use your uninsured motorist coverage which many times has a deductable. Can you talk to your agent? They should be able to tell you. Good Luck PLW


  2. You should refer to the SC Department of Insurance.  They are the ones who regulate the uninsured motorist, manditory deductible.

    In Texas, the deductible is $250, a decision made by TDI (Tx Dept. of Ins).  Because our states have so many people driving around illegally (without insurance), they have to collect money to be able to pay out on claims.  This is why you are subject to the deductible.  In many cases, your insurance company is able to retrieve this amount from the person who hit you.
