C-section!!!??????????

I had an emergency c-section after my babys heartrate would drop when i would have a contration. But they put me to sleep for it. I didn't even kno i was being put to sleep. Can someone tell me why they put me to sleep. And because I never gave consent to this....could I sue??? No negative comments please. I dont feel like arguing

  1. It was probably for your own good, but ive never heard of that. You should contact a lawyer and ask them, they will know if you can sue. They probably were supposed to ask a relative or something if they couldnt ask you.


  2. wow! I have never heard of them putting someone to sleep for a c-section.  But if that was me, I would want to be put to sleep.  I'm scared to death of needles and drs.

    If everything is ok with you and the baby I wouldn't bother with a law suit.  You could ask your Dr why they did it though.

I had a c-section, and they DID give me pain medication, but they DIDN'T put me to sleep...they're SUPPOSED to consult you before doing ANYTHING...and I DON'T think that's normal procedure...I'm not an attorney, I would use an attorney's free consultation to see whether you could sue over this, I'm not sure if a lawyer would take the case, I'm sure it depends on the laws in your state and the specifics in what happened in your case.  Was there ANYONE (like the father of the baby, for example) that could've authorized this when the doctor or other medical staff spoke to them out of your presence?  Maybe there was some danger to you?  Who knows...consult a lawyer, definitely, but have ALL the facts before you do!


  5. I was put under when i had my first, which was an emergency c-section and because the heart rate was dropping.

    Its usually because they dont have time to make sure the spinal is effective. Im not sure if you already had one in, but its definitely in the best interest in yours and the babies well being. You pretty much consented when you signed all of your admission papers stating that they could use reasonable medical treatment.

    A lawyer wont be able to help you unless there was malpractice. and putting someone under during a major surgery is normal practice.

    Now, if there is something wrong with you or your baby due to the being put to sleep, then you MAY have a case. But if you and your baby are healthy and recovering I would just thank God for the blessings, and be happy that all is fine now.

  6. If it was a true emergency, like your baby had to get out fast, then you would be put to sleep. I was put to sleep to when I had my first born, it sucks I know it was like I wasn't even there. If your baby and you are healthy I would just be thankful for that and try to move on. I know how you feel though. Good Luck!

  8. they did what was in your best interest and your babys.  your husband might have gave consent but they put you to sleep so you would not feel any pain.  or they swapped your baby for an aliens (but i kinda doubt it)

  10. Why do you want to sue?? just because you want some money? You did not mention having any problems afterwards nor did you suggest that anything weird happened while you were out, so what the big deal? If it was really an emergancy like you claim then that is why they put you to sleep. They did not have time to wait for the epidural, or maybe they gave you the epideral and then something happened and they had to use local anestisia because they could not wait any longer. You should be asking your dr why they put you under if it is such a big deal, instead of asking YA if you can sue..

  11. the reason they probly put you to sleep is that there was probly more risks they didint want you to stress about. if you ask more questions they might give you answers also talk to an attorny about the sue-ing part.

  12. They put you to sleep because there was no time to give you an epidural. Had they numbed you from the waist down, they would have wasted precious time in getting your baby out. Thank God that both of you are okay. Enjoy your baby! Congratulations!

  13. Well they had a reason to put you asleep or they wouldn't have. You said the magic word "Emergency C-section" --That is why...

    I was put to sleep during my c-section which i requested because i did not want to be laying there awake knowing i was getting cut open.

    As long as you and your child are healthy why are you worried? I mean why are you thinking about suing? Nothing was hurt.


  14. Even if your life was in imminent danger, they had no right to put you under without your consent. You have the right to refuse any and all interventions and they needed your consent. Did they get your consent for the c-section, because they needed your consent for that too. It doesn't matter whether your life was in danger or the baby's - if you are conscious and mentally competent, you still have the right to refuse treatment, even to the detriment of your health.

    If I were you, I would request my records and see whether the emergency c-sec was really necessary. Decelerations during a contraction are normal - what's abnormal is if the heartrate does not rebound between contractions. Sit down with a lawyer and talk it out. However, it will be very hard to prove damages, so a lawsuit might not be worth it. At the very least, however, you could file a complaint with the state medical board.


  15. When my mom had me by c-section, they asked her whether she wanted to be out or awake. It seems odd that they would do this unless they had a medical reason. I think if you sue they will probably claim that it was to keep everything calm while they tried to save your baby. However, I would talk to a lawyer.

It is possible that at the time with everything else that was going on it was easier to put you to sleep than to try and do everything else to prep for a c-section since it was an emergency situation. If everything is okay with you and the baby, I would just let it go. You can ask you doc why they put you to sleep though.

  17. Sue happy country, Gees! It could be both You & the baby was in danger. No wonder DRs are afraid of ppl, always trying to sue. Ok, I'm calm. Ask the dr why, if the hospital thinks you were in any danger or a danger to others then I would let it go. If the baby is in stress, so will you. I wouldn't mind being put to sleep if my reaction to knowing the my baby is in danger, will hurt her even more & myself. I would sit down & think afterward, would my reaction stressed me & the baby out knowing the baby is having problems. If the answer is yes, then I ask you to let it go. My blood pressure is too high & I am 34 weeks pregnant. My dr says if it doesn't drop, I will have a C-Section even though I want natural birth. They may have put you to sleep to keep you calm during a very stressful time. It may be that hospital's policy to put a woman to sleep if having an emergency c-section. I'm sorry if I came off negative.  

  18. when you sign consents for delivery part of the consent is for an emergency c/s if necessary and another is for anesthesia to take care of you.  First of all the medication they give you to put you to sleep causes short term memory loss of the events immediately before they give it to you.

    My answer to you is No you cannot sue.  There is nothing illegal about what was done to you.  There was an obvious emergency in which either they could not wait for the epidural to take complete affect or it was not effective enough at the time that they needed to do the c-section.

    In order to show that an injury is the result of medical malpractice, there are three things that must be proven:

    "1) It must be shown that the injury or death was a result of a breach of the accepted standard of care. That is, it must be proven that a doctor or health care professional made a mistake that would not be expected from a competent practitioner."

        - There was no injury or death to you or your baby so this is not met.  Especially because what they did helped prevent injury or death to you and your baby.

      

    "2) The mistake made by the health care practitioner must be proven to be the definitive cause of injury or death. Most often, medical malpractice occurs when a patient is being treated for an existing illness. It must be proven that the care provided by the health care professional is the cause of the present injury, not the existing illness or some other factor."

       - okay, see #1...

    "3) There must be demonstrable damages caused directly by the injury. Damages from medical malpractice may take the form of pain and suffering, increased medical bills, lost wages or benefits, or the loss of a loved one in the case of wrongful death."

      - again...see #1....

    Sorry - I know you said that no negative comments but you should be thankful that both you and your baby are alive and healthy.  It makes me sick that you are thinking this way.  These people were trying to help you and ensure a safe and healthy passage for your baby into this world and all you can think about is "i didn't say okay how much money can I get"

  19. YOU SHOULD GO SEE A LAWYER. U SHOULD BE ABLEL TO SUE B/C THEY HAD TO USE ANESTESIA AND IF U THEY DIDNT GIVE U ANYTHING TO SIGN THEN U SHOULD BE ABLE TO. THE ONLY THING THEY SHOULDVE GAVE U WAS AN EPIDORLE(excuse my spelling) TO NUMB U
