CA Law,"Expungement,Process. " PLEASE HELP!!?

Hello, I have a quick question to ask regarding the expungement process. If a person was not arrested, but he was charged and convicted of a Misdemeanor with Battery being the offense, And the person who commited the crime did not go on probation/Juvie/Jail, But only paid a Fine, and the person who commited the crime was 16 years old, and that person did not commit any more crimes before and after the only one he had commited, is he illegible for an expungement in the state of California? Please help guys i need you.

  1. For an offense committed when you were a juvenile, you can do better than have the record expunged, you can have it sealed.  Go to this site, and follow the "Juvenile Records" link.

    Please note that contrary to what KC V suggests, this is NOT automatic when you turn 18.  You MUST file a petition to have the record sealed.


  2. If the conviction of the offense was at a time when the "actor" was a minor or only 16 years of age...then there is no "official adult criminal record" to worry about.

    As a juvenile offense the record of a juvenile is closed and only opened on very unique occurances if there is a serious crime committed as an adult.

    The court would then determine if there was a juvenile record on file that could be remotely associated with the adult crime.
