How far the case goes is not up to the sheriff, it is the prosecutor's decision.  But if his police report recommended no charges to be filed, then that might not give the prosecutor much to go off of.

  2. A conviction (actually an arrest) will be on your FBI record for ever. Even if not prosecuted. If you were fingerprinted it will show up on FBI. If you are prosecuted for minor offenses records are not accessible to the general public. So in affect they are sealed anyway.

  3. Juvenile records are inaccessible to the general public, which is commonly referred to as a sealed record.  And the previous answer from Superman is correct.  It is up to the prosecutor to decide to file charges or not.  Further, it is not uncommon for a DA to file a case before ever speaking with the arresting sheriff's deputy or police officer.
