CAN A LIE DETECTOR TEST BE USED TO CATCH A LYING POLICE OFFICER??? Advice Needed!

Ok... Here's The Thing. I Was Arrested For Resisting/Obstructing An Officer Without Violence. I Was Arrested For Checking On A Family Member... And I Shouldn't Have Been. I Didn't Pose As A Threat To The Investigation Going On With My Family Member And I Did QAttempt To Leave The Incident... However I Was Arrested Falsely... And When I Got The Police Report A Few Days Ago... I Noticed That The Cop LIED!!!!!! And I Am Still In Shock!!! I Want To Clear My Name Because I Have No Witnesses And Was Wondering If A Lie Detector/ Polygraph Test Would Be Sufficent Evidence In Court??? What Would You Do??? Plz Help Me!!! I Didnt Do Any Thing Wrong!

  1. Let me get this straight. You intend to walk into a justice system court and force a uniformed cop into a lie detector test when they already had a case on you, a 20-year-old who wants to make the uniformed cop take a lie detector test with no other evidence than "I know he lied!"

  2. Polygraph/Lie Detectors are not sufficient evidence in court.  If you have a problem with the report the only thing you can do is take it up with the officer's supervisor.  

    No offense towards you but I once had an offender say to a judge "she's lying"  "but she lied" "she's not telling the truth" when my report worded EVERYTHING that happened step by step including every word uttered, no misinterpretation what so ever............and he really believed that making statements like that would get him out of a DUI.   I almost felt sorry for him because of how pathetically arrogant he was sounding.  I must admit it was the first time anyone tried saying I lied about anything and was rather insulted.......but I never laughed so hard in my life, I guess he was more drunk than I thought if he couldn't remember anything that happened.

You need to speak to the officers' supervisor and run the facts by him/her first and see what action if any they do for you,,,if you're not satisified then go a step higher and ask to talk to a higher person or their Internal Affairs Division,,this is a part of a P.D. or Sheriffs' Office that investigates misconduct of their own. You will be required to put your' complaint in writing and sign it.  Then the investigation will begin and yes a polygraph can be used to determine the officers guilt or innocents (and yours' too) within the department but it can not be used in court.  A polygraph is a investigative tool used but is not  admissible in court as evidence.

    When and if you do this keep youself calm and factual as all this takes time and if you happen to have to go to court before a conclussion speak to the State Attorney prosecuting the case and ask for a continuence of your case and explain to him,,if he/she won't grant it then plea not guilty as you will then get another court date for trial further down the road and that will give more time for the investigation..If the officer is found to be frabricating the charge against you then the S/A will be contacted and the charge should be dismissed or Nolle Pros. You then will need to contact the S/A and have him ask the judge to Exsponge your record as the charge will still follow you on record but it will just show no prosecution...A judge is the only one who can wipe the slate clean.....BUT NOW be aware if the investigation finds you are bs,ing about this fabricated charge against you  and you're just trying to get out of it then the officer has the right under Fla. Law to put a civil litagation (sue) against you as this complaint will follow him all his career in his personnel file regardless of its outcome.  A Internal Affairs file on any officer/deputy never gets wiped out for their entire career....

    NOW by all means you have the RIGHT to have a wrongdoing against you investigated and don,t be put of by any negative answers in the beginning or think if you do this they will then be after you..If that happens and you're harrassed about it you obtain a attorney and sue the P.D. of /Sheriffs Office,,thats also you're RIGHT......Good Luck

  4. Not having been there none of us know exactly what happened or who's lying. But theres no way you can make the officer take a polygraph in regard to this incident. Just present the base case you can and hope that you can get off without any severe punishment. I find it hard to beleive you were arrested for no reason; but without being there its hard to say.

    no one can be forced to take a polygraph test.

  6. Polygraph results cannot be used as evidence in court. They are not accurate enough.
