CAN MY DAUGHTERS DADS MOM GET CUSTUDY OF MY CHILD IF HE SIGNS OVER HIS RIGHTS? ?

OK THIS IS THE THING MY EX NEVER BEEN MARRIED, MY DAUGHTER IS 7. HE HAS BEEN IN & OUT OF JAIL SINCE SHE WAS 2. WELL JUST RECENTLY HE GOT INTO ALOT OF TROUBLE & IT LOOKS LIKE HE WILL BE IN THERE FOR A WHILE. WELL HE WRITES ME A LETTER SAYING THAT HE IS SIGNING HIS RIGHTS TO HIS MOTHER. CAN HE DO THAT??

  2. Parental Rights are the rights of the biological parent to have a say in the rearing of a child. Giving up those rights means you lose any input into the child's upbringing.

    Custody is a different matter. Custody refers to who the child will live with. Full custody means being a full time parent. A parent can have full custody but allow visitation, even overnight visitiations.  Your child's grandmother may take you to court for visitation privileges but not many states grant custody to a grandparent if at least one of the parents is active in the child's life.  

    By the way, giving up parental rights does not necessarily mean you no longer have financial responsibility.

  5. If you have custody of your child and he signs over his rights than you have full custody. If you don't have custody and he has parental rights and he signs them over I would think your parents and his parents will have to decide where the baby goes to.  

  6. I would definately consult a lawyer and get the answer straight from the horses mouth.  No need to be guessing about something as crucial as this matter.
