CAN MY WORKPLACE BE SUED FOR TELLING AN EMPLOYEE TO GET HIS g*y *** UPSTAIRS?

my manager paged one of my friends on the store phone and told him to get his g*y *** upstairs my friend is homosexual but they should in no way make such remarks. i felt it was totally wrong for him to do and my friend is upset about it and is considering quiting now. is there any laws for this. i live in florida

  3. typically work place harassment needs to be a severe incident (e..g physical assault) or a pattern of behavior so as to create a hostile work environment.  One insulting comment by itself is not likely severe enough to make it legally actionable.  Because the other managers immediately reprimanded him, his comment was not likely systematic and pervasive enough to rise to the level of hostile work environment.  Rude and inappropriate indeed, but probably not the basis for a legal claim.

  6. You can sue for anything in this country.  You just need a piece of paper and a pencil.  That does not mean that you have a case or will win.  

  7. Doubtful. And it would likely be tossed out of court on account of a frivolous lawsuit, and the judge would tell your friend to grow a backbone or go pound sand. so make sure you have an ultra-liberal judge who wastes time on drivel like this. Secondly, how can you prove damages? You cant win a case based on 'he said/she said' (heresay). Your friend can quit if he wants to, but to win a court case, you have to prove financial damages or show that a law has been broken beyond a reasonable doubt.

  8. In states that have laws that include homosexuality as a protected minority it could be discrimination, and in any state it could be sexual harassment.  The trick is proving it, but there's enough there in that simple statement to at least bring a law suit.
