Question:

CPS is investigating my sister over false allegations of abuse...what next?

My sister's 2 children were questioned by CPS at thier school. There was a call placed that both my sister and her husband "throw the kids up against the wall and beat them". The kids are 6 and 9. The 9 year old was asked to remove his clothes by the caseworker and examined for bruises. Nothing was found. The accusations are rediculous. CPS said they have to come to her house and do a "safety inspection". That was over a month ago, and no one has come. I suggested that she hire a lawyer, but they don't really have the money for that. They also have a 2 year old daughter that is home. They both have good jobs working at the same place, own thier home, and thier cars, etc. What is CPS trying to pull? This has stressed me out so much, espically with all the info online which talks about this agency stealing children from innocent families. I have become scared for my own children, who are 4, 3, and 1 year old. How can she protect herself, he husband and the kids from CPS?

  1. cps will investigate find the charges unfounded and that will be it  i would be more concerned about where the initial claim started and by whom

  2. She can't protect herself from them.  All she can do is live her life and care for her family.  As long as she is not harming her children she can do nothing else short of hiring an attorney.  I'd like to say she is safe as long as she is not harming her kids but that is sadly not the case.

  3. I think you protest to much.

CPS was following up on a complaint as they are required to do by law.

YOU have no idea what goes on when you are not there.  ou should be thankful for the CPS  and not believe all this BS about them.

  4. Just a little hysterical about this?

Do you seriously think that having waited a month to come do this safety inspection, CPS is really looking to steal your sister's kids for fun and profit?  Seems to me they'd have been there a lot sooner to enslave those children and start making money off them.

Your information is really skewed.  You should rely a little less on what you read online and a little more on just plain old common sense.  When you start to see CPS behaving inappropriately I think you can start to worry - until then, you're just stressing yourself out for no reason.

And you do realize that even people with "good jobs working at the same place, own thier home, and their cars, etc" abuse their kids, right?

  5. Kids will say the darndest things! I had this problem too. My son went to school and said some stupid things about me, and he was taken while I got charged with "Neglect."  A month and a half later it was dropped. Most of the time, they find out when a parent is innocent. Most of the time, it doesn't even go to court with a charge. I feel fortunate that I ended up with an honest social worker.

If a social worker really feels that a child is being abused, she is usually there within 48 hours. The fact that more than a month has passed without the investigation happening indicates that the SW doesn't really feel that any abuse  took place. She's just got your sister an a list of people to investigate when she can, just in case. It is likely to be a quick and easy visit if it ever happens! She's probably too busy dealing with real child abuse.

  6. CPS is not trying to pull anything. They received a complaint, and they are required to follow up on it.

It is not up to you to prove the charges are false, it is up to them to prove they are true. Don't worry about it.
