Question:

Cali: traffic ticket help?

I got a Infraction ticket for going 10mph over the speed limit pulling a car trailer.

My truck is lifted with bigger tires and apparently, I was going over the 55mph limit However, I had my cruiz control set at 60 (even while traffic was zooming past me..anyone live near L.A would know traffic...). So the cop just gave me a 65mph notice on it.

Amazing how 3/4 of the way I drove 55mph but speed up after many people honking and almost rear ending me as they where tailgating.

Details:

I am moving in two weeks out of state.

Notice going to another county in Cali (forward address).

Says can take up to a month if not longer to receive that notice (fine etc).

Do I have to report to Insurance right now or can I wait til I get the notice?

Reason also is, due to the move, we have AAA So. California which isn't transfer to another state. So have to make a whole knew policey according to AAA for the new state will be in. (States don't transfer policies).

Is there a possibility I can do traffic school in my new state?

Any ideas of the expense in the fine?

(I haven't had a ticket in over 4 years. Never a speeding ticket. The most I done was not use a blinker when turning).

  1. "My truck is lifted with bigger tires and apparently"

You may have had the wrong size tires.  Take the truck to a tire shop to see if this is the case, and if so, get the right size tires, and show judge the receipts from the tire shop stating you had gotten the correct size tires put on your truck, and they'll often dismiss the fine.

Edit:" (normally it is off about 5mph. But my husband said he noticed it gets worse as the speed increases when he drove and his friend mentioned the same thing)."

Ok, this should have been fixed when you first found out about the problem.

  2. sounds like the pigs, squashing the little guy and letting criminals go.

  3. The fine for a violation of Vehicle Code section 22349(a) is $146 (may vary slightly but not by much).  I'm not aware that having a trailer makes any difference.

You can attend on-line traffic school if you choose.

Are you suggesting that your new insurance company is or will ask you about any traffic tickets?  If you were not changing insurance companies, you would have no duty to tell AAA about the ticket either now or after you were convicted.  If the new company asks about pending tickets, I suppose you have to tell them - but you haven't been convicted yet (which means you aren't guilty of anything yet) so I doubt they're going to ask.

Larger tires make the speedometer (note spelling) report a slower speed than what you are travelling.  If you thought you were driving 60 but the CHP says you were driving 75, I think you have your answer now.  Your husband and his friend would seem to support that idea, also.

  4. first of all, congrats on your move. i am also out of cali. do your traffic school on line (i recommend trafficschooltogo.com) and mail your completed certificate to the court CERTIFIED MAIL.  you can go to court early and find out how much your fine is (it takes about 2 weeks for the court to have the information on file)

if you go to traffic school, you do not need to notify AAA. the ticket will not show on your record, and your insurance in either state will not be affected. (AAA is available where i am going, oregon)

as far as the fine goes, they are going to charge you extra because you were pulling a trailer.  expect about 300 and if it's less, cool

and get your cruise control looked at.

  5. No, but you can do an online traffic school from your new state.
