California Auto Insurance Cancellation?

How soon after an insurance company cancels an auto policy for non-payment will they report that cancellation to the dmv? I understand the electronic notification, but how quickly will the insurance company actually notify the dmv that the party is no longer covered? I have yet to receive a notification from dmv and my policy was cancelled 2 months ago.

Unfortunately, I was involved in an accident (my fault) and although I provided a copy of my policy info, I found out later that I was not covered at the time of the accident. I had the policy Rewritten the day after the accident (a different policy number). The other party reported it to their insurance, although we agreed to settle with cash & no insurance. They are requesting me to file an SR1 file. What do I do? The info I provided had good dates of coverage on it but I found out later that my policy had lapsed. Do I submit an SR1 with the old info or new info? Will my license be suspended now??? IM DESPERATE!

  1. Fill out SR1 with the correct information as it was at the time of the accident.  Depending upon your record, DMV may not approach if it's understood you now have insurance.  An attorney's not going to be able to help on this one.  During the next few years DMV may request sporadic proof of insurance on your part.


  2. Insurance you got after the fact will not cover the accident.  You will have to fill out the SR1 with the information that you were not insured at the time of the accident, since neither the old or new policies were in affect.

    The DMV wouldn't send you notice of cancellation since you got a new policy and are now covered.  If they do happen to send you a "turn in your license" letter, just send a copy of current insurance.

    Work with the damaged parties insurance to pay for the damage you caused.  Chances are they will let you make some kind of a payment arrangement if needed.

  3. hey player.....lets get this into perspective....u knew u didn't have any insurance...but drove any way...then when u get into a little trouble you run down and get insurance ...and now your worried about your license? you were playin Russian roulette and you shot yourself in the head....man-up...face the music and get it over with,you tried to skirt the system and got into a jam ,now you're trying to do it again?   you were drivin "gangster" (i don't need no crummy insurance) then....and now your a model american citizen.....why don't you tell them.......hey...i didn't need insurance to drive then so i don't need a licensee  to drive either.....my friend did the same thing and settled the claim for cash(thikin he had skirted the system)  14 months later he got sued for 75,000 dollars for injuries...at the time of the accident no one was hurt.......he lost in court.....go see a lawyer  before u settle anything with anybody ,at least for advise
