California g*y Marriage - Green Card?

So I met a European and fell in love. He is visiting on a school Visa, and in 5 months we will have to separate and never see each other again. He wants to be with me in America.

Now Cali allows g*y marriage. If straight Americans can marry immigrants and those immigrants obtain green cards, why can't g*y couples as well? Immigration is handled on a Federal level right? And the Feds wont recognize our marriage, then deport him. This is terrible. I am a good tax paying american and my love for another person is none of the Governments business. Think I could sue the Federal Government for denying me my Life, liberty, and pursuit of happiness or something of that matter?

  4. First off, good luck suing the government. They got a lot more money to fight it, and can appeal, appeal, appeal, and appeal some more until you're bankrupt and can't fight it anymore.

    Second, the fact is that the Federal government does not recognize g*y marriage (and California may not also, depending on how the voters vote on that amendment to the California Constitution that would ban g*y marriage and immediately make all g*y marriages in California null and void) is what is most important. If they don't recognize g*y marriage, then you can't use marriage to him to get him a green card. Not that that process works as well as it used to. There is still an application process and approval before he would get his green card, regardless of marriage to a US citizen.

  5. No, you cannot sue the federal government over this.
