California law for rear end car hit?

This is regarding an Incident

At 7 Am morning while my friends was on his way to office an old car appliedd his brake all of the sudden n my friends new car(6mts old) barely touched that car. (My friends car had no damage and he had a feeling as if that person reversed the gear) He asked for insurance information my friend gave his but he did not(neither he had his drivinglicensee nor insurance information) saying he is not having right now lets go to my home i have it at home. My friend denied as he was getting late work. My friend noted his car number.

In this situation who can be held liable.

I feel my friend should have called the cops at that time because he was not having any information in his car(no driving license, no insurance paper. As i told you he was in hurry he did not even do that.

Please tell in this situation who is liable?

  1. Your friend rear-ended the other car, so he is liable for the accident.

    The other guy's not having license or insurace paperwork on him is not a factor in the accident, so it has nothing to do with the liability.  If your friend had pushed the issue at the time, he could have gotten the guy in trouble, but he did not.  And unless you had witnesses saying that the guy reversed gears, it is not even worth trying to bring it up.

    Your friend should just contact his insurance company and have them wait until the other guy contacts them.
