California law? is this kidnap?

last nite my husband told me were go going to his moms and if i wanted to go, so i said yes, we have a 2 month old that the family wants to see, so this morning i wake up and hes gone and the baby's gone. I called his mom, sister, brother, all said hes not with them. so i tried his dad but no answer, its been 2 hours now, I'm a stay at home mom, and never been apart from my baby, is this kidnap because i was supposed to go, and i wasn't woke up. or m i just paranoid because i never been apart from my new baby? live in Southern California,and am debating on to call the police

  1. Since he is the father it is not kidnapping, but it does seem odd.  I would call the police anyway and explain what is happening.

I'd call the police to make sure he hasn't been in an accident.  It could be considered kidnapping, but not after only a few hours.  It is the baby's father.  There are several cases I know of where a child has been kidnapped by a parent, but the situation is different.  The child disappears for weeks or even years in those cases.  Not just a few hours.  Just keep trying to get ahold of him and ask his family members to have him call you if they see him.  Explain to them that you are worried about your husband and baby.  He probably just decided to go without you because he didn't think you really wanted to go.
