  2. Yes. If the patient and the doctor agree to undergo the procedure then they can do it.

    There is often disagreement on whether to do a procedure, and inevitably some patients fall near the 'borderline' of treatment (particularly when the 'disease' concerned is not life-threatening, such as arthritis or reflux disease). So in those circumstances one doctor may feel no surgery is needed and another may recommend it. It doesnt mean one is wrong and one is right, it's a just a difference in opinion. Inevitable in all professions.

    What does the patient do about it? Well, if he doesnt know he gets another opinion. Otherwise he can go with whichever opinion he likes best.
