Question:

Can Army commanders "LTC" hold you past your ETS date to make sure you do your extra duty?

i have a friend who thinks he can outsmart the system. He is banking on the chance that they wont pursue further action because he will be leaving the Army before they "CMD" process the paperwork. He screwed up "drugs" right before his terminal leave, they took it he is on 45 days extra duty, but after that he is out like a week later. he is not reporting to extra duty. I am telling him dont risk it because one man up, and two you dont know what the command is capable of, if they are willing to spend the time and effort to punish him. He would be disobeying a field grade officer so thats bad. I am curious if they can keep him in the army longer to allow for continued punishment.? Is a bad conduct discharge or other than honorable discharge a possible outcome?

  1. The Army has the power to return you to active duty for the purpose of prosecuting you in a military court!

    Yes, he can be held after his ETS date!

All the Commander has to do is charged him with a new crime (failure to obey a lawful order, dereliction of duty, AWOL [by not being at his appointed place of duty without permission to be absent]) and he will be held past his ETS date until he has served his sentence. If the Commander chooses to go that route, the legal office will make sure all the "i's" are dotted and the "t's" are crossed.

  3. maybe a dishonorable discharge.  Thats what my friend brother got from the marines because he didnt do the extra time they wanted him to do.  Basically your the military female dog.  and you run around cleaning up stuff.  basically a janitor.  anywho...he's stupid if he does that.  Get out with a honorable discharge.  so you dont look like a complete idiot applying to jobs with no experince.  I doubt he'll go to jail.......Most likely he isnt worth it to the military.  High schoolers just graduated :P

    The rules are simple. You play the game their way or they ram the bat up your ***.  Leavenworth is full of people who just couldn't understand the rules.


  6. Yes, you can be held.  They can also facilitate the extra duty by incarcerating him.

    He can not only be held but he can be further prosecuted for each additional charge.

  8. He'd be a fool to not show up.  Seriously, he should just do his time and get out.  It's only 45 days, not worth even the possibility of s******g up the rest of his life.
