Question:

Can Army discharge be denied after Physical Part 2 exam?

My Husband is a E-1, and we've been stationed here in Fort Bliss for 1 1/2 Years now. He was Discharged for Chapter 13.....He has already done the last Physical Exam Part 2 test, which means he couldn't work anymore..... They just found out they are deploying to Saudi Arabia, the commander now denied his discharge because they need him for deploy...... Is that wrong? After Physical Part 2, he shouldn't be able to work at all... how can this Commander Deny it? isn't there a law against this??????????? please give me advice, links, or anything I can look up against this...

  1. Was he busted for indebtedness? E1 with 18 months? Anyway if he was med-boarded then they should process him out...I don't understand your question...

    I was a Navy Corpsman and have never heard of  a "Physical Exam Part 2 test" unless it is an Army thing. Something doesn't sound right.

    But you also said he was discharged for chapter 13? Was he fully separated or not. Because an administrative discharge for debt and a physical discharge are two completely different animals.

    And if he was discharged he wouldn't be deploying, he would be going home. Someone doesn't have all the facts together. Either you are very confused or your hubby is lying to you about something.


  2. It is up to his command.  If the do not want to discharge him, they do not have to. There is no law against it.

  3. an E1 for 18 months?!    what kind of trouble has he gotten into anyway?  

    but yes, if the Med Board finds him  deployable they can indeed  deploy him.
