Can D.O.T. wake me up out of the sleeper to give me a log violation?

I was illegally parked in california and sleeping. I was 40 ft. away from hwy. D.O.T. woke me up, told me that i was illegally parked and asked to see my logs. However, i didn't close out my hours w/ a V.I. B4 i went to sleep.

I was always told that you do not have to get out of the bunk and mess up your break since you have to log line 4 when you emerge from the bunk to talk to the DOT guy. I never had this occur, but frankly, I would probably come out from the bunk, especially in California where they HATE trucks!  I would go to court and fight the ticket but I really don't know how well you will do there since they are so anti-truck. My co-driver got a ticket for being in the left lane even when he was going to make a turn from the left lane! The cop told him he crossed over too soon and gave him a ticket. Tough enough out there without the anti-truck attitude! Good luck with this.

I would say yes, once you are up for being parked illegally they can ask to see your logs, you pissed off Mr DOT man and he's gonna make you pay.

They can make you move to a legal parking place but the log

violation is harrassment.  I'd fight it.

While they can wake you up for being illegally parked, ticket you and make you move. I would fight the log book ticket and you can do it through the mail. I fought a speeding ticket and won.
