Can Debt Collectors automatically deduct money from my paycheck without my permission?

I have a credit card I can't pay right now. My husband has been without work for a year now. I am working to support both him and my son. I can't even pay my car payment or rent or eat without help from family or church. Can a debt collector really do that? I thought I heard before that they can't...Is that harassment. This guy calls me at least once a week and is very rude even after I say I am contingent. HELP PLEASE!!!

  1. If you tell them you're "contingent" they say, "What?"  The word you are fishing for is "indigent" (look up both words).


  2. no they cannot automatically deduct money from your paycheck without your permission unless they sue you and get a court order that states that will happen.

  3. No, it is not harassment.   It is called wage garnishment.   It is legal in 49 states.

    They can not garish more then half your pay.

  4. Your husband can deliver pizzas while he's looking for a new job, I got a job I hate because I need the money, anyone can find a job, it may suck but it is income, while they are looking for a career.

  5. They need to go to court and get a judgment on you.  They just can't take money out of your check just because they feel like it.  So technically, yes they can.  But they either need your permission or the authorization from a judge to do so.

  6. This can happen only if they serve you a summons for a court date.....and on that date they win a judgement against you...after which point they may garnish wages. This process can take several weeks/months.  Otherwise, debt collectors have absolutely no power to take money out of your checking account/paycheck.
