I am here in USA on Student Visa(F1) and my Green Card processing date is going to be due next month hopefully for child under 21 basis. I would like to know that is there any possibility that I can bring my girl friend over here after marrying her? Because the main thing is that my process is based on Under 21 child dependent. Please help me out.????????

  1. I don't think you have the legal capacity to bring or petition your girlfriend.Only a US citizen has that capacity.

  2. No.  I do not believe that that is a possibility.

  3. It sounds like your petition is based upon you meeting the definition of the word "child." The key word is "unmarried." The definition of "child" is ---"unmarried and under 21." To qualify for the immigrant classification that you seek, you must remain unmarried.

If you want to marry your g/f after you get your green card, you can, but she will not gain any immigration benefits right away. She will not be able to live with you in the U.S., and the waiting period for her green card will be 5-6 years.

So, if you marry before you get your green card, you will not be eligible for an immigrant classification that includes the word "child". If you marry her after you become a legal resident, then you can go to her country, get married, petition for her, and wait until she gets her immigrant visa in her country in  5 to 6 years.
