Can I Kick My Roomate Out? (No lease)?

Here is the thing, My roommate quit his job, he is lazy and in-considerate. Never does the dishes or sweeps the floor. Never does any chores, and never buys food for the house. Somehow he manages to pay rent each month. Even with that I don't like depending on someone with no job. He is NOT on the lease and we have NOT lived here for longer then 60 days. So in the state of Pennsylvania can I tell him to get his stuff and get the h**l out? or do I need to give him a time frame. A refund for the rent he payed will NOT be a problem I just want this guy out of here.

  1. Your roomate has no lease and paye rent by the month, so he is your month to month tenant by default.

    You need to give him one full rental month's written notice to terminate his tenancy. If he does not vacate per the notice, you would have to evict him through the courts.


  2. I'm not sure what it's like in PA, but here in NC I just found out that you can't kick someone out. You actually have to go to court and evict them. If you ask them to leave and they say fine, then you can...but if they refuse to leave, you have to evict them. Which I thought was incredibly stupid. I found this out in a conversation with my mom, she was telling me about a woman who's husband beat her and whatnot, she owned a house, he was living with her and she was going through the court process of evicting him, but she couldn't just kick him out and he ended up killing her.

    I can understand needing to give notice to a bum roomie, don't want to make anyone homeless or anything...but in a domestic abuse situation and you can't kick someone out of your own house! It's craziness.

  3. If your landlord finds out you have a roommate, they could increase your rent or evict you. Your lease is a contract between you and your landlord. I could be wrong, but if you don't have a written agreement with your roomie, I don't think you are required to let him stay or give him notice.
