Can I apply for fiance visa 2nd time and also can i go to usa while waiting for the fiance visa?

I am a Romanian citizen and i had a fiance visa, but my fiance passed away in may 2007, 2 month before our wedding. After that i received a tourist visa while visiting USA this year i met my current boyfriend in person and we want to get married. I know him for 4 yrs and we used to be online friends while i was engaged with my previous fiance, but never saw eachother before this year and never had different intentions than being friends and talking. Am i eligible to a 2nd fiance visa? i know he can apply but would I have real chances to get it? Would they think i date Americans to get into USA ? :( while waiting for my 2nd fiance visa to be approved can i also visit him in USA (i want to go with him to his brother's wedding in December but would not want to fly 20 hrs and then be returned home at the point of entry because they think i will not return back home). I love my current boyfriend and i want to be with him, there is no hidden agenda and i know me beign eastern european and having a fiance visa on my passport could make them believe i want to get into usa by any means which is not the case, but since some do it i will be judged based on statistics... We consider the posibility of marrying and living in Romania but he is in the airforce and he will stay in till 2012 when his contract ends and we do not want to wait till then...

Pls give me some advise, I hope I am just being over paranoid

  1. For sure you would set off red flags.  Definitely sounds like you are out for only one thing and that is citizenship through marrying an American citizen.

  2. You are potentially eligible for a second fiance visa. You are right that coming from Eastern Europe your application will be under more scrutiny. However, if you submit a full package of information that shows the extent of your relationship, you do stand a fair chance of getting your visa. It would be best if you make sure to print out copies of emails as well as other documentation that proves your relationship and the ties of your relationship.

I think that you will have a hard time convincing the immigration authorities that, having been engaged last year, you are now engaged again to another American, without it raising lots of red flags.  You need to let your relationship develop further so that when you do apply, you can prove without any doubt that you are genuinely in love.

  6. d**n, this is almost exact situation I am in, except I am an American citizen and my girlfriend(future wife) is a Romanian citizen.  See, I have read into this a little, which by the time I am married I am sure I will be a pro.  I am pretty sure I will be able to give people advice on this situation and I don't think I would just post anything that doesn't help at all.  Anyway, I think that you should lay out a few different plans.  Obviously, they should have both the USA and the Romania ways to get married.  Then weigh your options?  Which is better?  I haven't finished this whole process yet, but when I do, I will be sure to let you know.  Also some people haven't been to Europe and are blind to fact that most love there country and don't want to move. Some people are just plain ignorant. Don't let this ever get you down.  If you finish your process before me, I would also like to know which way you found easier.  Thank you.
