If I would have left a comment on ebay stating " The items looks like a print from the computer" can I be sued. They said it hurt their business and they may need to seek damages

to pay for my loss of time and income based.

  1. I would think it would be Freedom of Speech. So you would be fine.but I'm not sure.

  2. It could be construed as libel if they got the best lawyer in town, but I would say that since you have "this item "LOOKS LIKE" etc.." you should be okay. You should be allowed to express your opinions/ concerns. but you cannot pass it off as fact if you do not know that it is true.

    Edit:

    Libel is written

    Slander is spoken.

  3. you can be sued for slander if this comment causes them financial loss. Just leave a negative feedback and vague comment "not the quality I was promised"

    :"item not as described"

    etc....

  4. You can be sued for anything by anyone.  If the claim is defamation of a product, that claim is not recognized at all in most states.  Where it is recognized, an opinion is not grounds for judgment against you.
