Question:

Can I call the trustee if my bankruptcy lawyer screwed up?

I just got a letter from the trustee saying they are trying to get my case dismissed because I didn't get a tax return in on time. They have filed a motion with the court. I faxed the return to my lawyer over a month ago. I called my lawyer about it and had to call them back when they didn't return my call. I talked to some idiot. It took him 10 minutes to figure out the return was in my file. He said someone would call me. No one has yet. I did what I was supposed to. They dropped the ball. What can I do?! I can't have it dismissed!

It sounds like this guy was NOT the idiot.  That said, I would have contacted the Trustee as soon as I received the letter.  If ANYONE involved fails to return your calls, contact them CONSTANTLY.  Get to the point you know their receptionist's favorite author.  When you no longer have to tell them who you are are why you are calling, they will do something to get you to stop calling.

  2. Call the trustee!  Let them know that you have been trying to reach your attorney.  Keep calling the attorney too.  If they dismiss you, all creditors will come after you big time.
