Can I change my child's last name without going to court?

When my eight year old son was born his father and I were not married but his dad IS on the birth certificate. We have now gotten married and I would like my son's name to be changed from my maiden name to his dad's. Can I do this through the birth certificate office or will I have to go through the court system. I called the health department and the lady who answered the phone confused me even more then I am now. If there is a special form at the health department that needs to be filled out can someone let me know what is called.

This depends on where you live and live the child was born but typically you can just file a petition from the state website to change the childs last name.  The father (since he is on the BC) will have to sign as well.  It didn't cost me more than 40.00 and I didn't have to go to court to do so, I just printed out the forms, signed and sent the information request away with a money order.
