Question:

Can I change my name on USCIS pending application?

Hi, I was in the US on student visa which expired in February. Then, I got married my long time boyfriend also in February and finally filed application (i-485, i-765, ...) with USCIS in June. I just received my first appointment notice for biometrics.

On my application, I used my husband's last name. Now, I would like to change it back to my maiden name. The reason is that my home country requires me to travel to Washington, DC twice to change my name on my passport, which I can't afford right now. So my question is: Can I change my name back to maiden name on USCIS application? How would I do it? and How long would that take and how much is it?

Thank you.

  1. Last i heard if you get married on student visa it voids it.you husband needs to petition for you with the I-130 form.

If you submit an application on him behalf as your spouse, he would most likely be denied all non-immigrant visas (e.g. visitors visa, student visa, etc...), as marriage to a permanent resident shows immigration intent.
