Can I collect Unemployment?

Can I collect Unemployment (UI) if I was asked to leave right after I gave my resignation? I gave my resignation today in the morning. Late this afternoon I was told that there was no need for me to stay, to pack up my belongings. My manager came over a few moments later and handed me my last check. So since I didn't quit "quit", can I collect?

  1. it depends whether or not you gave your resignation via email or in writing. If so, they have proof that you quit and for that unemployment will not pay for quitting unless its for a reason like sexual abuse or unreasonable conditions. I f you quit verbally, you can lie and say that they told you that they didnt need you . In other words, blame them for your unemploymnet and you will not have problem.


  2. You can APPLY for unemployment but you are unlikely to collect.  How can you claim you did not quit when you handed in a resignation?  

  3. You can apply, if your employer does not dispute your claim you will receive your unemployment.

This can be sticky.  Because they have your written/verbal resignation they have grounds to deny your unemployment.  Unemployment basically asks them "Do you have an opening or work available that they are qualified to do" and if they say yes but you didn't want the job.  They can always say that it was in the best interest of the company that you didn't stick around for the full two weeks etc.  Plus my friend from my experience....it helps much in the future when you quit instead of being fired.

  5. I don't think so. It was YOUR idea to leave, not your former employer's.   If you hadn't given your resignation, you'd still be employed there. The fact that they decided not to let you stay until the date you wanted to, doesn't change that.
