Can I collect a judgment from someone who is on disability

my ex-husband owe's me a ton of money, he disappeared a couple of years ago. I finally found him, it seems he is not working but is collecting $1600.00 a month from social security disability. Is there any law that protects him from collecting money he owe's me from a judgment.

  1. Nope, if you can get the judgement, he has to pay a reasonable payment to you. If not, you're without.


  2. Being on disability does not generally protect him from any liabilities to you or anyone else.  He still owes the money; nothing about being on disability made his debt go away.

    To the extent you can get money from him, you may as well pursue it.  Remember that even if he only has $1600/month in disability pay, he may have other assets.  These are also potentially on the table.  

  3. Nope.  If he owes you money and a court ordered him to pay than he has to pay.

    That said you cannot bankrupt him.  If he is unable to pay in full then a court will determine what he needs to live and demand monthly payments till the debt is paid.

    $1600/month is not a lot and particularly if he is on disability so don't expect much.

    The answer is YES!

    His disability CANNOT be garnished by you under ANY circumstances. If that is his only income and he does not have any other assets, your judgement is pretty much worthless.
