Not in my state. It is a community property state. You have to legally separate.

He lives there too. If you are married it doesn't matter who is on the lease or agreement.

And section 8 is "household", not an individual. You aren't scamming the government by failing to tell them you are married are you?

You probably need to initiate divorce proceedings, and get a Temporary Motion for Relief that would order him out.

I think if you followed eviction procedures like if he were any other tenant you would be fine, as long as he is not an owner of the property
