Can I expect privacy in public areas (e.g. Chuch. Can someone post pictures of my family on the internet?

Privacy Law. I attend church regulary and the pictures of my family end up on the church website without my consent. Is it legal. Do I have the right of privacy. Thank you for your time!

My understanding is that when you are in a public venue... there is implied consent.  Can you imagine asking the 100 people (possibly more) to all sign consent forms before they attend the church service? Where it becomes a privacy issue is when you have NO EXPECTATION to be on film ie. a friend is asking you questions over coffee, you're on the phone ... where you expect that you are only being heard by your friend.  If you have difficulty with your family appearing as part of the crowd it is your responsibility to find another venue.  In such a venue the church lets you know you're being filmed.

    Your question was vague... perhaps someone has snapped a photograph of you and your family that you were not aware of.  IF that's the case then yes... they must get consent before publicly posting it because you had the expectation of privacy.  Once again "the devil is in the details".   2. You have the right to privacy but that's something that doesn't exist for most of us anyway. You should be happy it's a church and not something worse. You can tell cops, but really, cops are idiots anyway. Good luck finding a good guy.

There is nothing illegal about it, but I'm sure though that if you ask whoever is responsible the site to take them down they will do it without a problem.  Just let them know that you prefer to not have pictures of you or your family used for the website or anything else (i.e. church bulletins).

  5. If you ask them they should just remove the pictures, if they dont you may be able to threaten with legal action, i dont see why it is a big deal though because it is just a church websight

  6. Yep... You have chosen to attend an open gathering of people and they have a photographer there taking pictures... They can do whatever they want with the pictures. If you don't like them, talk to the webmaster and have them removed. This is no different then you going to a concert and having your picture posted online.

  7. it's no illegal for them to do that but they should  ask for your consent, it's just proper manors. If you have a problem with them posting these images just calmly and politely explain why you do not want these images posted and request they take them down.

  9. There is no privacy in public today because of the technology. Just ask the church to remove the photos. Yes, they need your consent to publish your images, especially if faces show.

  10. There is no right to, nor expectation of, privacy in a public location.  In other words, if you choose to not be private, you have no right to privacy.

    In a public location like a church, or on the street, anyone can take a photo or video of you and post it online.  They cannot take 'private' photos legally (such as the notorious 'upskirt' photos taken under women's skirts, but if it is visible to the public, it is fair game.

    That said, your church should be willing to remove the photos if you complain, they are not trying to expose you, just trying (I assume) to show the happy congregation.


  11. Call your church and tell them that you don't want you pictures on there website. Also tell them that you would like them taken off immediately. Tell them that there are privacy laws about this kind of stuff.you should have a church attorney that you could also ask. Check out this link to someone asking the same question as you.
