Every one lies, if you want to lose weight don't drink that. Make your own smoothie. That's what I do. You can get frozen mixed fruit from the store and blend it with orange juice

did u realy have to ask this question 4 times? 4 TIMES??!?!? no u cant sue. are u fat? have dey been makin u fat while u ate there smoothies? did dey force a fat free, or so they claimed, smoothie down ur gullet? i think not. u shud just go to wendys for a baconator, at least u NO theres fat in there...

Tony - - this is the fourth time you've asked this question. You must be looking for a quick buck. In America, anybody can sue anybody else for anything! If it is declared a frivolous lawsuit, YOU can be liable for paying for the legal fees of the person you sued, and can also be countersued for defamation of character.

Unless you can PROVE that they use regular icecream I suggest that you just forget it and go somewhere else for your fatfree smoothie.

Probably not. "Fat free" doesn't mean there's no fat, it just means the fat content is below a particular legally set limit. You would be hard pressed trying to find a lawyer to take the case, and when you lose you could be liable for their legal expenses.

Also keep in mind that the fat content on the label are legally based on % fat by weight, not calories from fat. This is an important difference given how low-weight most fat products are.
