Can I file I-765 Employment Authorization??

My mother filed I-130 for me and its been approved. I am unmarried child over 21. I was told to wait for a visa number to be available befor filing for adjustment of status but i want to know if in the meantime while waiting I can file I-765 Employment Authorization???

  1. Yes, you could file an I-765. Approval would be doubtful.

    However, it could not be approved unless you were eligible to apply for adjustment of status or qualified for an EAD card some other way.

    Look at the instructions on the I-765. I don't think you are going to find that you qualify under any of the numerous categories of aliens who can have an EAD card.


  2. If you are filing purely based on an approved I-130 and you do not have a visa number which is current, you are not eligible to file Form I-765, unless you qualify in another way which you have not told us about.

  3. 1.  It's the country that you live in which matters a lot. If you are from bangladesh or pakistan or nepal; i.e any developing nation the the chances are   A BIG NOPE!

    2. If you are intelligent than EINSTIEN, and having experience like that of "MANMOHAN SINGH" then the countries like UK, CANADA can think for calling you  on Job basis.  

    3. As you said you are over 21 then it would take a lot of political aproach because once you are over 21 then the chance of immigration are very FEW.

    4. My friend I can give you ONE IDEA To immigrateto a countyr like Australia.  TRY the   ILETS test.
