Can I file for Child Support even though I am here illegally and the father is here legally?

I am worried if I can file if I will get sent back.

  3. Sounds like just another way to get americans to pay for illegals to me. How ever if it is an americans child he should take care of it. I would say there needs to be a DNA test done first. I as one american am tired of our government taking money from working american people and giving it all away all the time. I am sure that if you do get legal status you will go right down and apply for welfare also, tell me that was not by premeditate dd design.

  5. Hey tone us Americans have NO PROBLEMS with Americans. They could be here on Visa or Naturalized. They could be Mexican or from any nation, even Muslims don't really get looked down on anymore(just get a second looks). No we have a problem with ILLEGAL immigrants. We don't need to melt with people who disrespect the pot. In other words people need to follow the law to get here. As far as I'm concerned if the child is here legally it should go to the father while the mother is deported. Women and these anchor babies really bother me. Best you can do is talk to an immigration lawyer as others suggested as see if you can get legal status.

  7. Unfortunately, you're not supposed to be here in the first place (not racist or mean - just the letter of the law).  As such, drawing any attention to the fact that you're an illegal would likely result in your deportation.

  8. Call an immigration attorney first.  You don't want to draw attention to yourself if it could mean getting deported.  You need to begin your paperwork.  If your child was born in the US you have a better chance.

This is why it is hard to listen to some pople who have nothing to do but insult others. Everyone is entitled to leave  decent life.

    Your situation is tricky. You would have to speak to immigration attorney for legal standing. While you are entitled to the support you may be subject to deportation. However, there are ways around this and lawyer could also work on changing legal status.  Even if you are deported, which may not happen especially if child born in US, you are entitled to support and it would be sent to wherever you live.     Yes, you can petition the court for a judgment for child support. I would be very careful, however, if your are in the country illegally. If it becomes part of your hearing (since both of you will be ordered to appear). Since the court is part of the legal system, they may be compelled to detain you, and make arrangements for you to be removed from the country.

    If your child was born here, he or she is a US citizen, and may be considered an "illegal" in your country of origin.

    Your best bet is to find an immigration lawyer and try to obtain citizenship, or a legal right to remain in the US, prior to making your status part of the official court record. No doing so might mean that you and your child will be seperated by your deportation. The US will not "deport" your child, who is a citizen, with you.

  12. Anchor baby?  Yeah, I would be afraid if I were illegal to do anything with the courts too.  Part of being illegal.  The father should be taking care of his responsibility because he wants to.
