Can I fill for the renewal of my EAD if my I-485 (permanent residence)has been denied ??

I was in the process to obtain my permanent residence, but for an USCIS mistake my change of status has been denied. I filled already the Motion to reopen the case but I want to know if i can renew my EAD in the meantime, and if I can keep working till the motion is finish (may be one year)

No, you cannot renew your EAD.  You cannot remain in the US unless you get permission to remain during the appeal.  Your chances of winning an appeal are poor -- most appeals are denied.  Do you really want to spend all that time and money when you cannot work, cannot earn any income, etc?  You might do a great deal better going home now rather than waiting to be denied again & deported.

  4. you need to contact uscis and ask them this question...or even possibly go and talk to an immigration attorney (most will do a free consultation and actually give you good, useful information)

    if you have filed a motion to reopen the case you DO NOT have to leave the country.  you are allowed to stay here until the case is resolved (unless they--USCIS--has a specific reason for sending you home, not just because you were denied the change of status)
