I have already graduated from a US college and have completed my OPT. I am now Living in the Bahamas. I am going to school again in the US, which means I will be under an F-1 Visa. Can I get Married to a US citizen and continue my education under an F-1 Visa? will I be able to apply for a k-3 Visa while still in school?

  1. You risk huge problems if you enter with an F1 visa with intentions to marry and stay.

Better to enter on a K1 visa, get married and then apply for a green card.

You can attend school as a permanent resident.

  2. F-2 VISA

  3. No, you cannot get married and continue your education on a student visa.  And no, your spouse cannot apply for a spousal visa for you while you are in the US unless you entered on a fiancee visa.

If you are planning to marry, you will have to enter the US on a fiance visa and you will have 90 days to marry and apply for the spousal visa.  You will probably get temporary leave to remain while the spousal visa is processed, but you will not have authorization to attend school or to work.

If you are returning on an F1, you will have to leave the US as soon as you marry, or finish school first, then leave while a fiance visa is processed.

  4. No. We have too many women coming here, getting married in order to stay, then splitting on the men. We're also working on preventing women from coming here, getting pregnant, and using it to stay as well. America is fed up with women from other countries ******* their way into citizenship.

  5. Why would you need to apply for a K-3 visa? There is no need, you will already be in the United States on an F1.

The process is simple, you are on an F1, marry and then your husband files an I-130 and you file the AOS package concurrently.

You may still study throughout the whole process and within 8-12 months you will have your green card.

Obviously this is the simple version of events, but that is the general process.
